SERVICE COVERAGE

 

The parties agree that Adore and Keep Photography will provide the services of professional photography. We suggest that guests DONOT take photographs of our formal shots as well as getting out of their seats during the ceremony, as doing so may delay the process and effect, or ruin the outcome of your photographs. Due to the fact that weddings are uncontrolled events, we cannot guarantee any specific photograph or pose. We will, however, attempt to honour all special requests.

 

1. Entire Agreement and Alterations to the Agreement

This agreement contains the entire understanding between Adore and Keep Photography and the Couple, and supersedes all prior agreements between the parties. Amendments can be made with agreement from both parties, documented in writing.

 

2. Cooperative Spirit

Both parties agree to act reasonably, amicably, cooperatively and in good faith at all times.

 

3. Payment Policies

A deposit of $800 is accepted herewith to reserve event coverage for the service specified above. This deposit is non-refundable, as a result of loss of business due to turning away other clients interested in the date.

 

Upon the signing of this agreement and receipt of the $800deposit, Adore and Keep Photography will reserve the date and time agreed upon and indicated on the invoice.

 

Final payment of the difference owing needs to be made two weeks prior to the wedding date.

 

If the photographers are required to travel outside the Melbourne Metropolitan area, the photographers will accept78 cents per kilometre to cover petrol and car allowance, plus $30 per hour of travel.

When the photographers are expected to travel interstate, accommodation is required to be paid.

 

If the photographers are travelling within the state and the travel time home is not before midnight, then accommodation is also expected to be paid.

 

If the photographer is required to travel interstate, the cost for the return airline tickets, accommodation and car hire will be an additional fee.

 

4. Limit of Liability

Adore and Keep Photography shall not be liable for any amount greater than the sum of money that the Couple has paid to them, for any reason connected to this photographic engagement.

 

5. Direction

Adore and Keep Photography will make reasonable efforts at all times, in accordance with their professional judgement, as well as based on their pre-wedding discussion with the Couple, to ensure the photographs captured are of a high standard, on the condition that the Couple follow any reasonable and lawful direction given. Adore and Keep Photography is not responsible for a reduced quality or quantity of coverage where the Couple have expressly not followed the recommendation or direction of the Photographers.

 

6. Changes to details of the Wedding

It is the sole responsibility of the Couple to inform Adore and Keep Photography in writing or email about changes to the date, time and/or location of any wedding day event.

 

No change will be confirmed until Adore and Keep Photography replies with written acknowledgement confirming such changes.

 

7. Photographic Output

The Photographers will use their professional judgement, experience and risk management processes to deliver the best possible photographs to the Couple. Whilst every reasonable effort will be made at all times, Adore and Keep Photography cannot be held responsible for non-existent or inadequate photographic output due to factors outside their reasonable control, including but not limited to:

a) Interference or Obstruction by Wedding Participants (including vendors and attendees) and bystanders.

b) Natural Occurrences including, and not limited to, Weather, Fire, Natural, Disaster, Acts of God and similar events.

c) Photographic restrictions imposed by venues, wedding participants or for legal reasons.

d) Wedding participants who do not wish to be photographed, or are late, or are unavailable to be photographed, or do not follow the instructions of the Photographers.

e) Failure by the Couple to inform Adore and Keep Photography about specific photos that they wish to be taken.

f) Failure to provide the Photographers with reasonable time to discharge their duties.

g) Insufficient time due to event or other delays outside the photographer’s control.

h) Photographer illness, accidents or delays, subject to clause 8 and 9.

i) Changes to dates, times or locations of wedding day events that the Photographers were not informed about per paragraph 6.

8. Photographer Emergencies

In exceptional circumstances where a photographer assigned at the wedding is not available due to circumstances outside their reasonable control (including but not limited to illness, accident, natural disaster, transport issues), Adore and Keep Photography will always have another photographer of comparable skill on standby, preventing the risk of non-attendance.

9. Additional Protection for the Couple

In addition to the protection given to the Couple through this contract, Adore and Keep Photography agrees to give a partial or full refund for the following “worst case” scenarios:

a) If no photographer attends the wedding due to illness, accident or other reason,

b) If the Photographers become incapacitated or otherwise unable to continue to operate on the wedding day, and no further images are able to be captured.

c) If all photographs of the wedding are lost due to hardware or software error, theft, damage, or loss.

10. Copyright and Usage 

a) The Couple allows Adore and Keep Photography to exhibit images resulting from this assignment as an example of their work, for entrance into photographic competitions and to use in their professional portfolios

b) The Couple grants Adore and Keep Photography copyright of the images and the right to use and publish photographs for the web, social media, advertising, self-promotion and any other purpose in any manner and medium.

c) Adore and Keep Photography grants the Couple usage rights of the images for their personal usage and to transfer to their family and friends. This includes usage rights for printing, web usage and other reasonable personal usage. Be sure to credit Adore and Keep Photography when publishing to the internet.

 

11. Special Offers

a) Any special offers or packaged deals are strictly sold as a package. Removing items from the offer would nullify the deal and revert to current listed pricing for individual items.

b)For example, if the client books multiple photography packages with a discount, removing one of these packages would mean that the packages will be charged at the current, non-discounted rate.

12. Meals

a) For coverages that run into or past meal time at the reception, food must be supplied to the photographers, usually in the form of vendor meal according to the venue.

b) If a meal is not provided, the photographers will leave the venue for up to one hour in order to obtain a meal and may result in lost moments/captures.

 

13. Delivery of Images

High resolution, edited images will be provided on a USB to the nominated address within eight weeks of the wedding.
